Abstract
This Code regulates labor relations and other relations directly related to them, aimed at protecting the rights and freedoms of the parties to labor relations, establishing minimum guarantees of rights and freedoms in the sphere of labor. Labor shall be intended human activity aimed at creating material, spiritual and other values necessary for life and meeting the needs of man and society. Harmful production factor shall be intended a production factor, the impact of which can lead to illness in an employee. Hazardous production factor shall be intended production factor, the impact of which can lead to injury to an employee. Production factors of labor activity shall be intended technical, sanitary, hygienic, production, living and other conditions established by this Code and other regulatory legal acts of the Republic of Tajikistan.
The principles of the labor legislation of the Republic of Tajikistan are: (a) freedom of labor; (b) inadmissibility of restricting human and civil rights in labor relations; (c) prohibition of discrimination, forced labor and the use of female labor and the labor of minors in heavy, underground and hazardous work; (d) equality of rights and opportunities for workers; and (e) guarantees of social protection for workers. All citizens have equal rights to work; discrimination in labor relations is prohibited. Any distinction, exclusion or preference, refusal to hire, regardless of nationality, race, sex, language, religion, political opinion, social status, education, property, leading to a violation of equal opportunity in the field of labor is prohibited. Natural persons who believe that they have been discriminated against in employment relations may take legal action. Forced labor is prohibited. An employee, as a party to an employment contract, can be a citizen who has reached the age of fifteen.
The state guarantees to citizens in the field of employment protection from any form of discrimination and ensuring equal opportunities in obtaining a profession and work. It is prohibited to employ women in heavy and underground work and work with hazardous working conditions.
