Law on biological safety.

This Law shall regulate elaboration, testing, production, import and introduction into environment of genetically modified organisms and shall be aimed at the reduction of the unfavourable effects thereof upon human health, biodiversity, ecological balance and the state of environment. The Act consists of seven Chapters divided into 29 Articles: (1) general provisions; (2) the state management for ensuring biological safety; (3) the use in the closed loop systems of genetically modified organisms; (4) intentional release into environment of genetically modified organisms; (5) trade of genetically modified organisms and derivates thereof; (6) import and export of genetically modified organisms and derivates thereof; and (7) conclusive provisions. The Act shall be applicable to any activity related to reproduction, propagation, import, export, testing and use of micro-organisms, plants and animals modified genetically with the use of biotechnology techniques. GMO shall be classified in 4 categories in accordance with risk class. Activities related to GMO shall be subject to compulsory licensing. All legal and natural persons must inform the National Biological Safety Commission of the projected release of GMO in the environment or on internal market by presenting technical substantiation containing information and risk assessment for the environment and human health. The National Commission shall be authorized to authorize, to ban import of GMO or to request the additional information thereon.
