Law No. 1190 “On oil and gas”.

This Law establishes legal, economic, organizational framework and state policy in the field of oil and gas and aims to develop this industry in the Republic of Tajikistan. It covers the activities of natural persons and legal entities related to the projecting, prospecting, exploration, extraction, processing, transportation, storage, and provision of emergency and rescue services, including government control on security in the oil and gas industry. Oil and gas fields are the exclusive property of the state. The extracted oil and gas in accordance with the terms and conditions may be the property of legal entities, including the joint property of foreign natural persons and legal entities. Competence of the Government of the Republic of Tajikistan in the oil and gas industry shall be as follows: (a) definition of a unified state policy in the oil and gas industry; (b) approval of regulatory legal acts in the field of projecting, prospecting, exploration, extraction, processing, transportation, storage and turnover of oil and gas products; (c) appointment of the authorized state body in the oil and gas industry; (d) creation of the national reserve fund of oil and gas fields; (e) approval of the composition of the commission and regulations on the procedure for holding tenders for the provision of the right to use promising areas with oil and gas fields; (f) approval of the rules for using state-owned geological and geophysical data for educational, scientific, commercial purposes and their export outside the Republic of Tajikistan for further research; (g) establishing the procedure for making oil and gas reserves in the state balance and excluding them from the state balance; (h) approval of the pipeline construction line; and (i) implementation of another competence not prohibited by the legislation of the Republic of Tajikistan. Management of oil and gas fields shall be regulated by contracts. This Law consists of 6 Chapters divided into 20 Articles. Chapter 1 lays down general provisions. Chapter 2 regards state regulation in oil and gas sector. Chapter 3 establishes the procedure for prospecting of oil and gas deposits. Chapter 4 deals with main pipelines and transportation of oil and gas. Chapter 5 regards safety of oil and gas mining facilities and transportation system. Chapter 6 lays down final provisions.
