Abstract
This Code on Administrative Offencesdetails administrative offenses and penalties in the Republic of Tajikistan. It spans a wide range of sectors including public health, labor, environment, transportation, telecommunications, intellectual property, taxation, customs, and military service. The code outlines specific violations and assigns penalties—primarily monetary fines quantified in “calculation indicators”—based on the severity and recurrence of offenses, and the status of the offender (individual, official, or legal entity). Sanctions include warnings, fines, license suspensions, confiscations, and administrative arrests. It emphasizes principles of legality, fairness, and human rights, and incorporates amendments from laws enacted between 2009 and 2020, reflecting updates to enforcement mechanisms and procedural rules.
Article 42 establishes that a holder of hunting permit and the owner of license for keeping and carrying firearms can be deprived of the aforesaid right for the period varying from two months to ten years for systematic violation (administrative offences) of this Code. Article 113 establishes that violation of mandatory rules and regulations set forth for the prevention of the outbreak or spread of quarantine or other infectious diseases harmful for human beings shall entail application of fines. Chapter 9 establishes that violation of current legislation in the field of land tenure shall entail fines. Chapter 10 establishes that violation of current legislation in the field of subsoil management, in particular, exploration and mining, shall entail application of fines. Chapter 11 establishes that administrative offences in the field of water management, in particular, unauthorized water abstraction and damaging of waterworks, shall entail application of fines. Chapter 12 establishes that violation of current legislation on forest management, in particular, violation of state ownership of forests and illegal logging, shall entail application of fines. Chapter 14 establishes that violation of legislation on environmental, in particular, violation of legislation on protected areas and non-compliance with the provisions of environmental audit, shall entail application of fines. Chapter 16 establishes that destruction of crops by animals or human action and violation of current legislation of quarantine inspection of crops shall entail application of fines. Chapter 17 establishes that violation of veterinary and sanitary rules and regulations, in particular, those related to violation of quarantine of livestock and birds, shall entail application of fines. Chapter 18 establishes that violation of the legislation on application, transport, storage and management of plant protection means (pesticides) shall entail application of fines.
