Abstract
This Law establishes the legal and organizational framework of the system of state administration bodies, focusing on executive authorities subordinate and accountable to the President or the Government. It defines key concepts such as executive bodies, central and local executive authorities, coordination, decentralization, decentralization, internal control, and official supervision. The Law does not apply to local state authorities or self-governing bodies of settlements and villages, whose organization and functions are regulated by separate legislation. It is grounded in the Constitution and forms part of the broader system of national legislation on public administration.
The Law sets out the principles governing the activities of executive authorities, including the supremacy of law, efficiency, accountability, transparency, professionalism, decentralization, and public participation. It defines the composition of central executive authorities, which include the Executive Office of the President, ministries, state committees, bodies under the President or Government, and consultative-advisory bodies. The Law regulates their establishment, structure, financing, accountability, and coordination mechanisms, emphasizing hierarchical subordination, service supervision, and the role of central bodies in coordinating state policy within their respective sectors.
Detailed provisions are provided on the legal status, powers, and internal organization of ministries, state committees, and executive bodies under the President and Government, including the roles of ministers, chairpersons, and heads of bodies. The Law also regulates internal control systems, ministerial collegial bodies, and the possibility of creating subordinate services and agencies. It allows for the transfer of certain executive functions to local self-government bodies or organizations through administrative contracts when economically justified and in the public interest. The Law establishes liability for violations in accordance with national legislation.
