This Law focuses on establishing and ensuring gender equality and equal opportunities for men and women. It aims to eliminate discrimination based on gender in various spheres, particularly in public service and electoral rights. The legal framework is grounded in constitutional principles that advocate for equal rights and opportunities, emphasizing the importance of non-discrimination and equal access to political processes and public service roles. Key measures outlined in the document include the prohibition of any direct or indirect restrictions based on gender in public service recruitment and advancement. It mandates that collective agreements must include provisions ensuring equal rights and opportunities for both genders. Additionally, the document specifies that in cases of mass layoffs, the number of dismissals must be proportionate to the gender composition of the workforce. Employers are also required to demonstrate the absence of intent to discriminate in legal disputes related to gender discrimination. Implementation of the document involves oversight by the General Prosecutor of Tajikistan, who is responsible for ensuring compliance with the law. The document stipulates that physical and legal entities will face accountability for violations of its provisions. Furthermore, it encourages the participation of public organizations and trade unions in advocating for gender equality and in the development of policies aimed at enhancing equal opportunities, thereby fostering a collaborative approach to enforcement and compliance.
