Law No. 944 “On investment agreement.”

This Law regulates public relations regarding investment agreements aimed at the implementation of investment projects in strategically important and priority sectors of the national economy, and is aimed at encouraging and attracting investments into the Republic of Tajikistan. Investment agreement shall be intended an agreement concluded between the Government of the Republic of Tajikistan and the investor regarding the implementation of an investment project. Investor shall be intended a legal entity investing in the Republic of Tajikistan. Investment project shall be intended a commercial project that involves a significant amount of investment, including a high degree of financial, technological, environmental and other risks, and is strategically important for the development of a certain sector of the national economy and improving the standard of living of the population. This Law regulates relations between the Republic of Tajikistan and investors at all stages of preparation, signing, entry into force and implementation of an investment agreement, regardless of the subject of the investment project. It does not apply to projects implemented under agreements on concessions, production sharing, public-private partnerships, as well as investments made in the Republic of Tajikistan by other states. This Law establishes the composition and contents of an investment agreement. The state guarantees protection of special and additional copyrights, trademark rights and intellectual property rights of investors. Investors shall be granted preferential licensing regime.
