Law No. 964 “On anti-corruption expertise of normative legal acts and draft normative legal acts.”

This Law regulates legal and organizational framework for anti-corruption examination of regulatory legal acts and draft regulatory legal acts in order to identify in corruption-generating factors and taking measures to eliminate these factors. State anti-corruption expertise of regulatory legal acts and draft regulatory legal acts shall be intended activities to identify corruption-generating factors in regulatory legal acts, draft regulatory legal acts, carried out in the manner prescribed by the Government of the Republic of Tajikistan, entities authorized to conduct state anti-corruption expertise, based on the results of which an opinion is given, subject to mandatory consideration by the relevant state bodies. Anti-corruption expertise of regulatory legal acts and draft regulatory of legal acts shall be based on the following principles: (a) validity, impartiality (disinterestedness), objectivity and verifiability of results of anti-corruption expertise of regulatory legal acts and draft regulatory legal acts; (b) competence of persons conducting anti-corruption expertise of regulatory legal acts and draft regulatory legal acts; (c) independence of experts from the law-making body; (d) obligation to conduct anti-corruption expertise of draft regulatory legal acts; (e) cooperation and exchange of information between state bodies, self-government of villages and rural districts (their officials) with citizens and public organizations in conducting anti-corruption expertise of regulatory legal acts and draft regulatory legal acts; (f) obligation to consider the conclusion of the anti-corruption expertise of regulatory legal acts and draft regulatory legal acts; (g) transparency and ensuring the possibility of familiarization with the results of anti-corruption examination of regulatory legal acts and draft regulatory legal acts; and (h) responsibility of the subjects authorized to conduct anti-corruption expertise regulatory legal acts and draft regulatory legal acts for the quality of anti-corruption expertise.
