Strategy for Countering Corruption in the Republic of Tajikistan for the period of 2013-2020.

Strategy for Countering Corruption in the Republic of Tajikistan for the period of 2013-2020 is a nationwide multi-sectoral policy document aimed at active participation of all branches of government and civil society in the process of its implementation. Countering corruption covers activities of all public authorities to identify, prevent and eliminate causes and conditions, contributing to the occurrence of corruption situations, identifying and combating corruption offenses and crimes, elimination of their negative consequences, ensuring rights and freedoms, improving the standard of living of citizens, development of the economy and ensuring the security of the country. This Strategy as an important state document laid a solid foundation for strengthening the fight and preventing corruption crimes, within its framework found the solution of the main issues in the field of combating corruption, taking into account the conclusions of sociological research, experience of law enforcement agencies of other states and statistical analysis of the state of corruption over the past period in the country.
Within the framework of this Strategy, in the appropriate regulatory legal acts were inserted regulatory issues related to effective fight against corruption and timely initiation and conduct of inquiry and investigation of cases of corruption crimes, jurisdiction of administrative offenses of a corruption nature, good governance and transparency mechanism in activities of state bodies, accounting and financial reporting, implementation by electronic means and through banks of payment for services of state bodies and institutions, other measures provided for in the Strategy.
The National Council for Combating Corruption was established as a nationwide advisory body on coordination of the activities of state bodies and involvement of civil society to implement measures for the prevention and countering corruption, and paved the way for the implementation of a number of effective anti-corruption measures at the national level.
The goal of this Strategy shall be to reduce the level of corruption, regular elimination of obstacles, creation of conditions for economic development, development of democratic values, improving the well-being of the population. In the process of implementing the requirements of the Strategy, the following objectives shall be achieved: (a) direct assistance in the implementation of the National strategy and development; (b) gradual improvement of anti-corruption policy; (c) ensuring the development of economic and social spheres and political stability; (d) organization and provision of effective management in government bodies and various spheres of public life; (e) organization and implementation of electronic management in all spheres of economic and social life within Concepts for the formation of electronic government in the Republic of Tajikistan; (f) strengthening people's confidence in the state, ensuring wide participation of society in public administration; and (g) increasing citizens' confidence in the activities of state structures.
In order to achieve the goals of the Strategy, shall be performed the following tasks: (a) improving the legal and institutional framework for prevention, detection and suppression of corruption offenses, optimization of forms, methods, means for countering corruption; (b) ensuring the implementation of regulatory legal acts and anti-corruption policy documents, creation of conditions conducive to the elimination of the occurrence of corruption situations; (c) expansion and intensification of international cooperation of Tajikistan in the field of combating corruption; (d) interaction with structures of civil society; (d) ensuring that members of society comply with the norms of anti-corruption behavior, including the use of coercive measures in accordance with current legislation; and (e) correct management of financial turnover, commercial transactions, investments, strengthened state-public control of this process, the creation of all favorable and preferential conditions for investment in Tajikistan and assets, modern equipment and technologies due to various sources of funding.
Implementation of the Strategy shall be based on the following principles: (a) the rule of law; (b) protection of constitutional rights, freedoms and legitimate interests of a person and a citizen, as well as interests of the state against corruption; (c) creation of favorable conditions for elimination of the grounds of corruption; (d) integrity, transparency and accountability of the activities of legislative, executive and judicial bodies; (e) recognition of corruption as one of the systemic risks for the national security, as well as an obstacle for the development of the national economy; (f) public-private partnership, including non-government organizations and public associations, with a view to take out business out of shadowy economy; (g) simplification of the procedural order of the investigation of corruption and the establishment of penalties in the amount, proportional to (illicit enrichment) or financial damage and confiscation of property as the main type of criminal punishment; and (h) transparent and close cooperation of state bodies with civil society and international organizations.
