Abstract
The ASEAN Framework Agreement on the Facilitation of Goods in Transit, signed on 16 December 1998, in Hanoi, Vietnam, is designed to make the cross-border movement of goods smoother, faster, and more efficient among ASEAN countries by creating a common legal and operational framework for transit transport. Its first objective is explicitly trade-oriented: to facilitate the transportation of goods in transit in a way that supports the implementation of the ASEAN Free Trade Area and deepens regional economic integration by improving connectivity and reducing friction in the movement of goods. A second core objective is regulatory: the Agreement seeks to simplify and harmonize the rules and requirements that govern transit—especially in transport, trade, and customs—so that operators face clearer, more consistent procedures across borders. This responds to the broader preambular commitment to cooperation and the shared aim of encouraging 'smooth, rapid and efficient' goods movement, aligned with international principles such as the GATT 1994 Freedom of Transit. In practice, the Agreement sets a platform for standardization through common principles and coordinated administration, helping reduce duplicative processes and uncertainty for transit movements.
Finally, the Agreement’s third objective is systemic: it aims to establish an effective, efficient, integrated, and harmonized ASEAN transit transport system. This is pursued through a structured approach that operationalizes the framework via implementing protocols covering key enablers—designated routes and frontier posts, technical requirements for vehicles, insurance arrangements, customs transit systems, and sanitary/phytosanitary measures—so that transit transport functions as a coherent regional network rather than fragmented national regimes. The overall intent is to create a predictable, interoperable transit architecture that strengthens regional logistics corridors and supports broader economic integration goals.
