Abstract
This Joint Order approves a new Procedure for the Certification of Foodstuffs in order to implement the Sanitary Code of Turkmenistan and the laws on certification and food safety and quality. The Joint Order sets out the legal framework governing the mandatory certification of foodstuffs produced in Turkmenistan, imported into the country, or exported abroad, as well as materials used for food packaging.
The approved Procedure regulates the certification process in detail, defining the roles and responsibilities of certification bodies, laboratories, experts, and applicants. It establishes the documentation required, application timelines, inspection methods, sampling rules, laboratory testing requirements, and the issuance, validity, suspension, renewal, duplication, or revocation of conformity certificates. Separate chapters address certification for imported products, domestically produced goods, and export products, including voluntary certification for exports. It also provides rules for recognizing foreign certificates or laboratory test results in accordance with international agreements or national procedures.
In addition, the Procedure sets out provisions on payment for certification services, applicant responsibilities, record-keeping, dispute resolution, and liability for non-compliance. It specifies that conformity certificates are generally valid for up to one year, subject to product shelf life and regulatory requirements, and outlines conditions under which certification may be denied, suspended, or cancelled. The document concludes by confirming that disputes may be appealed under administrative law and that unregulated issues are governed by other national applicable legal acts.
