Law “On Energy Saving and Energy Efficiency.”

This Law establishes the legal, economic and organizational framework for stimulating energy conservation and increasing energy efficiency. Energy efficiency indicator is a scientifically based absolute or specific value of consumption of fuel and energy resources (taking into account their standard losses) for the production of a unit of product, performance of work and provision of services for any purpose, established by regulatory documents in the field of energy saving and energy efficiency. Energy saving shall be intended implementation of organizational, legal, technical, technological, economic and other measures aimed at reducing the volume of energy resources used while maintaining the corresponding beneficial effect from their use, including the volume of goods produced (work performed, services rendered). The subjects of relations in the field of energy saving and energy efficiency are producers and consumers of fuel and energy resources, energy audit institutions, as well as bodies exercising state regulation and control in the field of energy saving and energy efficiency. The objects of relations in the field of energy saving and energy efficiency are fuel and energy resources and the corresponding equipment that produces and consumes them, technological processes associated with the consumption, transportation and storage of fuel and energy resources, permanent structures (buildings, structures) and other objects provided for by this Law. Legal regulation in the field of energy saving and energy efficiency is based on the principles of: (a) scientific, technical and economic feasibility of energy saving measures; (b) systematic management and control; (c) priority for the introduction of energy-efficient equipment, technologies and materials; (d) stimulating energy saving and increasing energy efficiency; and (e) carrying out a balanced tariff policy and pricing in the field of production and consumption of fuel and energy resources. The types of goods (works, services) for government needs that are subject to requirements for energy saving and energy efficiency indicators are established by the authorized body. Designed, constructed, reconstructed, and overhauled capital structures (buildings, structures) must comply with the requirements of the legislation of Turkmenistan on energy saving and energy efficiency. Requirements for energy efficiency of permanent structures (buildings, structures) are subject to revision at least once every five years in the manner established by the authorized body. Produced, transmitted, consumed fuel and energy resources are subject to mandatory instrument accounting in the manner established by the legislation of Turkmenistan. State support in the field of energy saving and energy efficiency can be provided in the following areas: (a) assistance in the implementation of investment activities; (b) assistance in the development, production and use of goods, technologies and materials that have high energy efficiency; (c) assistance in the construction of energy-efficient multi-apartment residential buildings; (d) support for the implementation of programs in the field of energy saving and energy efficiency; and (e) assistance in carrying out research work in the field of energy saving and energy efficiency, including financing the development and improvement of the methodological and regulatory framework. This Law contains VIII Chapters divided into 44 Articles. Chapter I lays down general provisions. Chapter II regards state regulation and control in the field of energy saving and energy efficiency. Chapter III establishes general requirements in the field of energy saving and energy efficiency. Chapter IV regards programs in the field of energy saving and energy efficiency. Chapter V regards energy survey. Chapter VI regards state support in the field of energy saving and energy efficiency. Chapter VII establishes state control over compliance with legislative requirements related to energy saving and energy efficiency, and impact measures in case of inefficient use of fuel and energy resources. Chapter VIII lays down conclusive provisions.
