Abstract
This Law establishes the legal basis for the production, harvesting, processing, storage, trade, transportation and use of grain crops in Turkmenistan. The objectives of this Law shall be to reduce the dependence of the state consumers on the external grain market by means of development of grain farming and processing of grain products in the state, formation and development of the grain industry, creation of favorable legal, economic and organizational conditions for local grain producers. The objectives of this Law shall be to establish general rules for the production of grain, to regulate the grain market, and to ensure the quality of grain products. The objects of grain-growing activity are grain products, including final consumption thereof, land, technical and technological means that are in contact at all stages of grain production in one form or another, as well as auxiliary natural and artificial materials used in grain-growing activity. Subjects of grain-growing activity are legal entities and natural persons engaged in the production, harvesting, storage, transportation, trade, import and export of grain products. Cultivation, harvesting, storage and transportation of grain crops to the enterprises for the reception and procurement of grains are carried out in accordance with the requirements of regulatory documents and technological standards in the field of grain farming. Grain and grain products from foreign countries may be imported into the territory of Turkmenistan in accordance with the legislation of Turkmenistan. Import of grain crops, including their seeds, intended for testing of varieties in various soil and climatic conditions, scientific research, selection works, as well as display at exhibitions, shall be carried out by permission of the authorized body in accordance with the procedure established by law of Turkmenistan. Export of grain and grain products is carried out in accordance with the normative legal acts and international agreements of Turkmenistan. State support for grain farming takes the following forms: (a) assistance to specialized seed farms in the cultivation of super-elite and elite varieties of seeds; (b) provision of state privileges on production costs; (c) provision of loans on preferential terms; (d) provision of tax privileges; (e) assistance in introduction of new progressive technologies of grain production and storage; and (f) provision of other privileges provided by the legislation of Turkmenistan. State grain resources stock consist of: (a) food grain; (b) fodder grain; (c) seed grain; (d) grain marketing resources; and (e) state reserves (strategic reserves of the state). State grain resources are formed at the expense of local production and import of grain crops. State grain resources are the property of Turkmenistan. Quality of grain products is ensured in the following ways: (a) regulation of requirements to the quality of grain products; (b) assessment of the quality of grain products; (c) certification of grain products; (e) standardization in the field of grain farming; and (e) implementation of state control over the quality of grain products. This Law consists of VII Chapters divided into 26 Articles. Chapter I lays down general provisions, Chapter II regards state management in the field of grain farming. Chapter III regards state support of grain farming and state grain stock reserves. Chapter IV regards business entities for acceptance and procurement of grain. Chapter V regards quality of grains. Chapter VI regards training of staff and scientific substantiation of grain farming. Chapter VII lays down final provisions.
