Abstract
This Law regulates the procedures for procuring goods, works, and services to meet state needs through competitive tendering. Its primary objectives are to ensure efficient use of public funds, promote fair competition among suppliers, increase transparency and accountability in procurement, and support small and medium-sized enterprises and organizations of persons with disabilities. The Law defines key concepts such as tender, customer, organizer, supplier, contractor, goods, works, and services, and establishes the legal framework governing public procurement, while also specifying exclusions (e.g. state secrets, emergency situations, certain government-approved contracts).
The Law sets out the institutional framework for tendering, designating the Cabinet of Ministers and other authorized state bodies as responsible for regulation and oversight. It defines the roles and responsibilities of tender organizers, tender commissions, customers, potential suppliers, bidders, and contractors, including confidentiality obligations and conflict-of-interest rules. Detailed qualification requirements are established for potential suppliers, covering legal capacity, technical and professional competence, financial standing, and absence of insolvency. The Law also allows for preliminary qualification procedures and permits, under specific conditions, limitations on participation to domestic suppliers or certain categories of entities.
The legislation comprehensively regulates tender procedures, including types of tenders (open, restricted, and request for quotations), preparation and content of tender documentation, submission and opening of bids, evaluation criteria, selection of the most economically advantageous offer, and circumstances under which a tender may be declared void or cancelled. It further governs the conclusion and execution of procurement contracts, including performance guarantees and limits on their amount, as well as liability for violations and mechanisms for dispute resolution through complaints or courts. The Law concludes with provisions on financing tender-related costs and forms of official notifications.
