Abstract
This Law sets forth legal and organizational grounds for protection of the atmospheric air against emissions of pollutants and ensuring environmental security and prevention of negative impact of economic activities on human health and environments. Atmospheric air protection shall be based upon the following principles: (a) ensuring the right to favorable environment and public health protection; (b) public management and regulation of emissions; (c) prevention of air pollution and harm to the environment; (d) resolving issues of atmospheric air protection on a scientific basis; (e) the introduction and use of energy-saving and (or) resource-saving technologies, the best available technical methods in order to reduce emissions of pollutants into the atmosphere; (f) availability of environmental information on the state of atmospheric air, harmful physical impacts on it and measures to protect it; and (g) liability for violation of the legislation of Turkmenistan on the protection of atmospheric air and compensation for damage caused as a result of air pollution as a result of economic and other activities. State management in the field of atmospheric air protection is carried out by the Cabinet of Ministers of Turkmenistan, the authorized executive body in the field of environmental protection, the authorized executive body in the field of health care and the medical industry and other authorized state bodies, as well as local executive bodies and local government bodies. Sources of emissions of pollutants into the atmosphere are classified as stationary, mobile and non-stationary. Classification of pollutants by hazard class is carried out to determine the amount of payments for emissions of pollutants into the atmosphere, the amount of compensation for damage caused to the environment by emissions of pollutants into the atmosphere. Standards for the quality of atmospheric air perform the functions of establishing standards for maximum permissible emissions of pollutants into the atmospheric air, ensuring environmental safety and public health, during the implementation of economic and other activities. State monitoring of atmospheric air includes a system of observations of the state of atmospheric air in order to meet the needs of the state, legal entities and individuals for reliable information on the quality of atmospheric air, its pollution, as well as a forecast of possible changes in the state of atmospheric air and an assessment of the degree of its pollution. This Law contains VIII Sections divided into 47 Articles. Section I lays down general provisions. Section II regards public administration in the field of air protection. Section III regards standardization in the field of atmospheric air protection. Section IV establishes air protection requirements. Section V regards accounting, statistics and reporting on emissions to the atmospheric air. Section VI regards state monitoring and control of the atmospheric air. Section VII regards international cooperation. Section VIII lays down final provisions.
