Abstract
To regulate living organisms and the application of modern biotechnology

This Act consists of 27 sections divided into 5 parts: part 1 outlines the short title, the interpretation of terms, the precautionary approach application and that the Act binds the crown; Part 2 provides the establishment of the National Biosafety Advisory Committee its structure, functions and powers. The appointment of a District Biosafety Advisory Committees where its functions shall be determined by the Minister. It describes the role of the Ministry relating to the Cartagena Protocol, the powers of a secretary and that other statutory powers not to be affected; Part 3 involves import procedures, approvals for imports, scientific risk assessments and that certain information is of a confidential nature, exemptions conditions from procedure and review of decisions; Part 4, states other regulatory requirements on exportation of living modified organisms and other conditions; Part 5, on miscellaneous describes offences and penalties. This part also includes appointment of designated environment officers and the Minister may, with the consent of Cabinet, make Regulations for the purposes of implementing the provisions of this Act and the Cartagena Protocol.
