Abstract
These Regulations prescribe general conservation and management measures and measures for the protection of specific species. They also prohibit the use of certain gear and provide for enforcement. The Regulations, made under the Fisheries Act 1989 and continuing into existence under the Fisheries Management Act, make provision with respect to various matters relating to marine fisheries in Tonga, including: (a) licensing of local fishing and commercial sport fishing; (b) licensing of foreign fishing vessels; (c) conditions that apply to foreign fishing vessel licences; (d) reporting by foreign vessels; (e) transhipment of fish; (f) fish processing establishment licences; (g) marketing of fish; (h) prohibited fishing of marine mammals; (i) exportation of fish products; and (j) use of fish fences and fish aggregating devices.
The 39 regulations are divided into 7 Parts: Preliminary (I); General Conservation and Management Measures (II); Prohibited Fishing Methods (III); Species Conservation and Management (IV); Fish Fences (V); Fish Aggregation Devices (VI); Miscellaneous Provisions (VII). General conservation measures include the establishment of annual and production and export quotas by species and by area, the regulation of the export of live fish, the appointment of inspectors and returns to be made by sellers and purchasers with respect to sale and purchase of specified species. Part III contains a regulation on marine mammals. Fishing for marine mammals is prohibited except fishing a small number for scientific purposes (reg. 9). Part IV contains conservation measures in respect of specified species. The Regulations also define offences and prescribe penalties for such offences and provide rules for the conservation of specified species of fish and aquatic animals including lobster, turtles and coral. The Schedules to these Regulations, among other things, contain forms, prescribe fees, contain indication for marking of vessels and prescribe close seasons and the size of fish.
