Abstract
These Regulations prescribe general conservation and management measures and measures for the protection of specific species. They also prohibit the use of certain gear and provide for enforcement. The Regulations also concern, among other things: determination rights to participate in fishery (allocation of fishing rights); the content of a fishery plan as provided for in the Fisheries Management Act 2002; boundaries of special management areas; form for fishing licences and fishing licence fees; protection of marine mammals and specified fish species and aquatic animals; fish fences; fishing for home consumption; fish aggregation devices; and compliance with other conservation and management measures.
No person shall fish for, harm or interfere with any marine mammal in the fisheries waters and no person shall have in his or her possession a marine mammal, live or dead or part of a marine mammal or a product derived from a marine mammal, where the marine mammal has been killed or taken in contravention of the provisions of these Regulations. The Secretary, however, may give written authorisation to fish for marine mammals in a limited manner and only in exceptional circumstances involving international scientific research which is intended to result in significant benefit for marine mammals, and will not cause harm or injury to the species. The Regulations are completed by 13 Schedules (fees, close seasons, illustrations of fish species, forms, conditions of licence, etc.)
