Abstract
This Act makes provision for the establishment of the National Food Authority and the National Food Council and provides for the control on the quality of food, including imported food or food intended for exportation. The principal functions of the Authority shall include: to employ risk management with the goal of ensuring that all: (i) food produced in Tonga, whether for domestic consumption or export; and (ii) food distributed or marketed in Tonga, whatever its origin; meets the prescribed standards of food safety and food quality; to coordinate and harmonize food control activities in Tonga at all stages of production, manufacture and distribution; formulate strategies and policies on food, nutrition and food security; to provide food safety and food quality inspection and certification services. The National Food Council shall advise the Authority and carry out various other advisory and supervisory functions.
The Authority may, based on credible scientific information and in accordance with applicable international standards, ban or set limits on the presence of additives, contaminants and residues in food or animal feed and may, by Order, prohibit the importation, cultivation, taking, harvesting or obtaining of that food of food injurious to health. All food businesses shall obtain a licence and comply with Regulations made under this Act, including rules on hygiene and labelling. They shall also establish and implement a traceability system. The Act further sets out requirements for imported or exported food, provides with respect to inspections and defines offences.
