Ozone Layer Protection (Amendment) Act (No. 4 of 2021).

This Act inserts definitions of HFC (hydrofluorocarbons) and ozone officer to the Principal Act. The Principal Act is amended deleting the words “environment officer” wherever it appears and replacing it with the words “ozone officer”. Part VII of the Schedule of the Principal Act regarding HFC is amended and new Part IX is inserted to the Schedule.
New section 3A is inserted to the Principal Act as regards codes of practice, standards and operating procedures and testing. This Act amends Section 4 about the composition of the National Ozone Advisory Committee.
It inserts new subsection 2A under Section 5 of the Principal Act which prohibits the import from a non-party of any bulk HFC specified in Part IX of the Schedule from 1 January 2024, and new subsection (3) is inserted under Section 6 specifying goods containing HFC which are subject to this prohibition.
Section 8 is amended as regards the prohibition of export of any bulk controlled substances specified in Part I, II, III, IV, V, VI, VII, VIII and IX of the Schedule. Section 9 of the Principal Act is amended as regards the prohibition of manufacturing within the Kingdom of the substance or goods that contains controlled substances which are listed in that section.
Paragraph (b) of the Section 12 of the Principal Act is amended as regards the need to phase out ozone depleting substances and the need to phase down HFC, except for essential uses. New subsections (2A) and (2B) are inserted under Section 13 regarding the requirements of the handling and storage of Methyl Bromide.
Section 18 of the Principal Act laying down some definitions is amended. Section 18A is amended regarding quota limit of HCFC and HFC. Section 18B of the Principal Act is amended regarding allocation of quota for HCFC and HFC – first quota period. The title of Sections 18C, 18D, 18E, 18F, 18G and 18H is amended as “18C Allocation of quota for HCFC and HFC”, "18D Quota size for HCFC and HFC – second quota period”, “18E Quota size for HCFC and HFC –subsequent quota period”, “18F Transfer of quota – HCFC and HFC”, “18G Reserve quota limit – HCFC and HFC”, and “18H Allocation of reserve quota – HCFC and HFC”.
New sections 24A on access to customs information and 24B on provision of information relevant to controlled substances are inserted. This Act inserts new section 25A on appeal of a decision of the Chief Executive Officer relating to the issuance, renewal or cancellation of a licence or permit, or the conditions attached to a licence or permit.
