Abstract
This Act makes amendments in the Registrar General Act, Chap. 19:03 by inserting new provisions regarding the contracts or agreements for sale and their registration; obligation of the Registrar General to keep a separate index for all instruments of trusts registered under the Registration of Deeds Act; and registration fees.
The Registration of Deeds Act is amended by inserting new sections on the registration of documents for all purposes, including the creation, transfer or conveyance of land; execution and attestation of every deed required or intended to be registered; form and content of contract for sale or other disposition of land to be registered; form and content of registrable documents; and offences and fines. It also amends the Schedule by inserting Forms C, D, E1, E2, E3, E4, E5, F, G, H, I, J, K, L, M and N.
This Act amends the Conveyancing and Law of Property Act by inserting new definitions to Section 2, and by inserting new sections regarding the precede every Deed for the conveyance of an interest in land by a contract or agreement for the sale or other disposition of that interest; registration of contracts for the sale or other disposition of land or any interest in land; land to be granted by registration; and offences and legal proceedings.
Section 26 of the Registration of Title to Lands Act is amended as A declaration of trust respecting land or any interest therein shall be by Deed in accordance with section 27 of the Registration of Deeds Act . This Act also amends Section 55(2) regarding the registration of a Deed of trust in accordance with the Registration of Deeds Act.
