Abstract
These Regulations, made under the Ozone Layer Protection Act, provide for the control of and aim at the reduction of the manufacture, importation, exportation, use, sale and movement of ozone depleting substances. They also fulfill Tuvalu’s obligation under Montreal Protocol. The precautionary principle must always be applied when the Minister makes decisions regarding the importation, use, sell, storage and movement of ozone depleting substances. The Regulations provide for a system of permits for various activities involving ozone depleting substances and introduce various prohibitions. The Schedules, among other things, list controlled substances and various authorities and their functions under these Regulations.
