Abstract
This Act regulates the importation and distribution of medicines and other therapeutic products (including also poisons) in Tuvalu and provides rules relative to the business of pharmacist. Various provisions of this Act also apply to veterinary drugs. The Act: (a) regulates the sourcing of therapeutic products into Tuvalu, including the manufacture and import of such products; (b) regulates the and supply chain for therapeutic products within Tuvalu, including the sale or supply of therapeutic products by wholesale or retail; (c) controls other activities associated with the use of therapeutic products, including prescribing, dispensing, operating a pharmacy, administering, compounding, packaging, advertising, disposal, and other related activities.
The Act establishes the National Drugs and Therapeutics Committee, which shall develop, and submit to the Minister for approval, a National Medicines Policy. The Committee shall also, among other things, maintain and publish the Tuvalu Essential Medicines List in accordance with the National Medicines Policy. Unless authorised by the licensing authority, no person may import, manufacture, sell, supply or promote any therapeutic product unless that product has been approved by a recognised regulator and is on the Tuvalu Medicines Schedule. No person may prescribe a prescription medicine unless they are an authorised prescriber. No veterinary surgeon shall prescribe any prescription medicine otherwise than in the practice of his profession for the treatment of an animal under his or her care.
