Abstract
The Tuvalu Fisheries Authority Act 2023 establishes the Tuvalu Fisheries Authority (TFA) as a statutory body tasked with managing, conserving, and optimizing the sustainable use of the country's marine resources. The Act outlines the functions and powers of the TFA, including engaging in fisheries management, regional cooperation, and enforcement, as well as negotiating international agreements. The Authority is also empowered to regulate the fish industry, ensure maritime security, and act on behalf of Tuvalu in regional and international fisheries forums. The Board of Directors, chaired by the Fisheries Minister, governs the TFA and is responsible for strategic oversight and national alignment of fisheries policy.
The Act further provides for financial governance, including funding from Parliament, preparation of annual budgets and corporate plans, and mandatory audits by the Auditor-General. It establishes strong accountability through detailed reporting requirements and performance monitoring. Provisions are also made for staffing, management, and the transfer of assets and functions from the former Fisheries Department. The Act consists of 23 Articles.
