Abstract
The Act consists of 79 sections divided into 12 Parts: Preliminary (I); The Tanzania Atomic Energy Commission (II); Control of the use of ionizing radiation sources and installations (III); Control of radioactivity in foodstuffs (IV); Radiation protection, physical protection, nuclear safety, radioactive waste management and emergency preparedness (V); The control of radiation exposure from natural sources (VI); The control of devices producing non ionizing radiation (VII); The promotion of atomic energy and nuclear technology (VIII); The operations of the Commission relating to radiation protection services (IX); Financial resources of the Commission (X); Miscellaneous provisions (XI); Consequential and transitional provisions (XII).
This Act shall apply to Mainland Tanzania as well as Tanzania Zanzibar in respect of all persons or body of persons whose undertakings involve or include generally the use of atomic energy and nuclear technology and in particular the production, processing, handling, use, holding, possessing, storage, transport and disposal of natural and artificial radioactive materials and radiation devices in respect of any other activity which involves a risk or harm arising from radiation (sect. 3). Section 4 further defines the application sphere of the Act. The Tanzania Atomic Energy Commission is established under section 5 and its functions are set out in section 6. The provisions of Part IV shall be read together with the Tanzania Food, Drugs and Cosmetics Act, 2003. The Commission shall, in consultation with the Tanzania Food and Drugs Authority and competent institutions, establish a system designated for the control of radioactivity in foodstuffs (sect. 29). Manufacturers of importers or exporters of food specified in Regulations shall obtain a radioactivity analysis certificate in respect of food distributed for human and animal consumption (sect. 30). Accumulation of radioactive waste on premises for further disposal requires an authorization of the Commission (sect. 33). Before granting its authorization, the Commission shall consult with local authorities, water utilization, river basin or other public authorities as appear proper (sect. 35).
