Electricity (Generation, Transmission and Distribution Activities) Rules, 2023.

These Regulations, comprising 105 sections, aim to regulate (i) electricity generation including generation for own use, transmission, distribution and cross-border trade in electricity activities in Mainland Tanzania; (ii) eligible customers; (iii) control room management. Part II of the Regulations establishes the licensing framework for regulated electricity generation, transmission, distribution, and cross-border electricity trade. It sets out the procedures for applying for, granting, renewing, transferring, suspending, and revoking licences and provisional licences, as well as the requirements for public consultation, exemptions, appeals, and regulatory oversight by the Authority. Part III sets out the obligations of licensees engaged in electricity generation, transmission, distribution, and cross-border electricity trade, establishing their operational, service, reporting, and compliance responsibilities. It also provides for customer service standards, compensation for losses, regulatory reporting, compliance audits, and performance improvement measures to ensure the safe, reliable, and efficient delivery of regulated electricity services. Part IV establishes financial obligations for licensees, requiring timely submission of budgets, regulatory reports, and audited statements in line with Authority standards. It also mandates proper separation of accounts for different activities and licences, with limited exceptions for vertically integrated entities, and prohibits cross-subsidization to ensure financial transparency and clear separation between regulated and other activities. Part V sets technical obligations for electricity generation, transmission, and distribution licensees to ensure reliable, safe, and efficient power system operations. It also regulates metering accuracy, testing, reporting, and monitoring of performance, losses, and service quality. Transmission and distribution operators are required to provide fair and non-discriminatory access, maintain and expand networks, manage outages and emergencies, reduce losses, and ensure safety. Part VII establishes the compliance monitoring and enforcement framework for regulated electricity activities. It grants the Authority powers to inspect licensees’ facilities, records, equipment, and systems to verify compliance with applicable requirements. It also sets standards of conduct for inspectors, requiring fairness, professionalism, and integrity during inspections, while providing a mechanism for complaints against their conduct. Part VIII establishes requirements for safe and effective control room management in electricity operations. The Part also requires proper alarm and SCADA system management, continuous system verification, change control processes, and incorporation of operational experience to improve performance. Additionally, it sets standards for the control room environment to support safe and efficient operations.
