Abstract
These Regulations, made by the Minister of State responsible for the environment under sections 143, 144 and 230 of the Environmental Management Act, concern the prevention and control of air pollution and require the National Environmental Standards Committee to, among other things: prescribe criteria and procedure for measurement for air quality; (b) establish ambient air quality standards; (c) establish emission standard for various sources of air pollution. They also define enforcement powers of the National Environment Management Council, defines offences and provide for appeal against decisions of the decision of the Council, an Environmental Inspector or local Environment Management Officers to the Minister and appeal against the decision of the Minister with the Environmental Appeals Tribunal.
Every person shall be required to comply with the minimum air quality standards approved and published pursuant to these Regulations. The Council shall designate certain categories of human activities to be main air polluting activities for which prior grant of pollutant emission permit by the Council shall be mandatory. The Minister shall publish in the Gazette the minimum air quality standards prepared by the National Environmental Standards Committee. The Council may, in case of (suspected) breach, issue a compliance order.
