Abstract
These Regulations consisting of 37 articles aim at (i) eliminating the production and consumption of ozone depleting substances; (ii) controlling the production and consumption of HFCs with high global warming potential; (iii) regulating the production, import, export, transit, transport, trade, disposal and use of ozone depleting and HFCs with high global warming potential products that contain, are made with or dependent on, or designed to contain these substances; (iv) promoting measures, strategies, programs, incentives, equipment and technologies in favor of the use of ozone friendly and low global warming potential substances and products; (v) facilitating the link between National Ozone Unit and the Ozone Secretariat of the Protocol. The Regulations establishes that (i) it is prohibited the manufacture, import, export, sell, offer for sale of the different chemicals or controlled substances listed in the various Schedules attached at the end of the Regulations based on without a permit issued by the concerned authorities depending on the kind of substance.
The reference authority is the National Ozone Unit that will work in cooperation with the sector environmental sections for (i) overseeing national programs on controlled substances and products; (ii) preparing policies, strategies and other measures for phase out of controlled substances and products; (iii) supporting industry, servicing sector and end-users on phasing out of controlled substances and products; (iv) promoting recovery, reclamation and recycling efforts; and (v) maintaining the required data.
Part III deals with the powers of the inspectors and the possible offences, as well as the emergency protection orders that can be served if it was necessary. Rules are provided also for customs verification in case of import and export of any controlled substance or product and labelling for importing or selling these substances (art. 24). Article 33 provides for the disposal of equipment containing controlled substances.
