Abstract
These Regulations, comprising 26 Sections, aim to provide a framework for liability, compensation, and the right to compensation. This includes compensation for a person who suffers damage while protecting the environment, or for personal or property damage resulting from environmental harm. The National Environment Management Council is responsible for enforcing these regulations, promoting best environmental practices, and managing public engagement. It also handles legal actions for compensation, facilitates mediation, assesses environmental damage, and keeps records of environmental incidents. Section 9 establishes that an owner or operator whose act or omission directly or indirectly causes damage to a person, property, or the environment shall be liable for compensation. The forms of liability can be administrative, civil, or criminal, depending on the nature and gravity of the damage. Section 11 specifies the conditions under which an owner or operator is not held liable for compensation. Part V, on Access to Information, outlines the right to access environmental information held by a public authority. Part VI details the process for filing a compensation claim for environmental damage. Eligible claimants are those who suffered personal or property damage, or harm while protecting the environment.
