Abstract
These Regulations, comprising 20 articles, are designed to protect the environment while promoting the sustainable development of small-scale mining - defined as mining operations conducted under a primary mining license. The goal is to help operators minimize their ecological footprint and contribute to sustainable resource management, benefiting both the environment and local communities. The Regulations are structured as follows (i) Preliminary Provisions: These establish the framework for compliance and interpretation. Key requirements include conducting a baseline environmental investigation and social study to assess the potential impacts of mining activities on the environment and local communities. Additionally, an environmental audit of existing operations is required to evaluate current practices and identify areas for improvement; (ii) Environmental Protection Plans (EPP): A review process is outlined to ensure that EPPs remain effective and relevant over time; (iii) Environmental Standards: Detailed in Part III, these standards impose strict limitations on pollution discharge and prohibit unauthorized activities. Notably, the use of cyanide in mining processes is banned to prevent harmful environmental effects; (iv) Penalties for Breaches: The Regulations include provisions for penalties, ensuring accountability among operators; (v) Monitoring Compliance: Operators are required to take reasonable measures to mitigate any non-compliance impacts and report these actions to the relevant authorities. This proactive approach is intended to foster a culture of environmental responsibility within the mining sector.
