Abstract
These Regulations consisting of 23 articles establish in article a Security Committee for the Mirerani Controlled Area to advise the Commission on security, environment, and management of the Mining Controlled Area. The rules governing the Controlled Area designated by the Minister are outlined in Part III, as follows (i) the area must be enclosed by a wall with a main gate for entry and exit, where everyone must pass through for control purposes; (ii) notice boards in both Kiswahili and English must be displayed, and mineral rights holders must fence their areas, and display notice boards; (iii) mining activities are restricted within 200 meters of the wall, and violations of these regulations are subject to fines; (iv) only authorized personnel with identification cards can enter the Controlled Area, with specific rules for visitors and penalties for unauthorized entry or remaining after permitted hours; (v) the Commission and authorized persons have the power to search individuals, vehicles, and the area itself for illegally obtained minerals (vi) any authorization granted by the Commission can be revoked or modified at its discretion; (vi) the Commission is responsible for collecting and managing fees and contributions from mineral rights holders and others involved in activities within the Controlled Area.
