Abstract
These Regulations have been made under the Tanzania Tobacco Board Act, 1984. They regulate the cultivation and marketing of tobacco. The 53 regulations are divided into 7 Parts: Preliminary (I); Plant protection rules (II); Contract farming (III); Marketing procedures (IV); Tobacco inspectors (V); Licences and fees (VI); Miscellaneous (VII).
No person shall grow tobacco unless he is registered with the Tobacco Board (reg. 4). Regulation 8 provides for the registration of processing factories. Regulation 10 of Part II declares growing of varieties of tobacco other than those indicated by the Commissioner of Agriculture to be an offence. Regulations 11 to 17 place further restrictions on the growing of tobacco and the importation of seeds. Plant protection measures include compulsory periods of sowing and cultivation, sanitary measures in respect of transport and handling facilities, previous authorization of use of agro-chemicals, and restrictions on intercropping. Provisions of Part III prescribe a minimum period of three years for a tobacco purchase contract between a buyer and a grower, lay down rules in respect of such contracts, and require that all tobacco sales shall take place at the buying centre (reg. 20) and that all tobacco classification shall be done by the Board (reg. 25). Any buyer of greenleaf tobacco from the field shall obtain a buying permit from the regional authorities (reg. 26). Regulations 27 and 28 further provide for the grading and classification of tobacco. Other provisions of Part IV regulate in detail the packing, transport and other handling of tobacco after cultivation and again provide for contracting.
