Abstract
These Regulations, comprising 34 articles organized into VI Parts, apply to any area designated and declared to be a water authority, a clustered water authority, or to any person providing or using water supply and sanitation services. Part II focuses on the provision and protection of sewage and wastewater facilities. In particular, it establishes that (i) water authorities develop and maintain sanitation works, including infrastructure for the collection, conveyance, treatment, and disposal of wastewater; (ii) anyone excavating or performing activities within the specified wayleave of a public sewer or sanitation works must obtain written consent from the water authority. Part III mandates that premises owners or occupiers or private sewers located within thirty meters of a public sewer must connect to it, with certain exceptions and prohibitions on what can be discharged. This ensures proper wastewater management and prevents illicit connections. Part IV outlines comprehensive regulations for sanitation services, focusing on sewer connections and waste management. It details the application process for sewer connections, requiring a prescribed form and payment, after which the water authority must connect the premises within fourteen days. The water authority can request wastewater sample analysis before connection, and if the waste is deemed harmful, it can mandate pre-treatment installation at the applicant's cost. Furthermore, Part IV addresses trade waste agreements, allowing the water authority to contract with private operators to discharge or treat sewage and wastewater, outlining specific terms and conditions such as discharge rates, sample checking, and fees. Finally, it covers miscellaneous provisions, including the construction of inspection chambers, rules for private and public sewers on private lands, requirements for cesspools and septic tanks to discharge into sewers, and the maintenance responsibilities for private sewers.
