Abstract
These Regulations implement provisions of the Water Supply and Sanitation Act 2019 concerning, among other things, water authorities and water supply in a specific area by a water authority. The Regulations shall apply to an area designated and declared to be a Water authority and to any other entity or person providing water supply and sanitation services such as a community organization. Subject to section 9 of the Act, the Minister may (a) declare an area specified in a notice (form prescribed in the First Schedule of these Regulations) as a water authority; and (b) cluster water authorities. Such area shall at minimum be a township, district headquarter, regional headquarter, national water scheme or a cluster of community organizations. Water Authorities shall be categorized by the Energy and Water Utilities Regulatory Authority (EWURA) according to their performance (there shall be a performance contract). A Water Authority shall obtain a licence from EWURA. A license issued by EWURA may either be of class I, II or III. Water authorities may be assisted by the Rural Water Supply and Sanitation Agency (RUWASA).
The Regulations set out rules for water supply and related services. Services supplied by water authorities or similar shall meet the prescribed quality standards issued by the Tanzania Bureau of Standards and any other relevant authority. Water authorities may carry out certain works on private lands for purposes of water supply.
