Abstract
These regulations, consisting of 33 sections divided into six parts, are designed to govern the establishment and management of captive facilities. These facilities can be located in various areas, including outside reserved lands, village lands with appropriate approval, or controlled environments. Furthermore, wildlife orphanage facilities are required to be managed by a government institution, a non-profit organization, or a collaborative effort between both. In the process of establishing these facilities, the Director General (meaning the Chief Executive of Tanzania Wildlife Management Authority) plays a crucial role, which includes overseeing and providing technical advice, receiving and evaluating applications, maintaining a registry of successful applicants, deciding on the registration of wildlife captive facilities, issuing certificates of registration and trophy dealer's licenses, assessing operator performance, supervising conservation efforts, conducting resource monitoring and inventory, monitoring animal population trends, providing guidelines for management plans, facilitating research, extension, and training, issuing permits for wildlife utilization, collaborating on wildlife quarantine facilities, and inspecting wildlife captive facilities.
Sections 6 and 7 address the criteria that the Director General must consider for the registration of wildlife ranches, farms, breeding facilities, zoos, and sanctuaries, as well as wildlife orphanage facilities, specifically for animals incapacitated due to physical disability or the absence of parental care. The operational requirements for a wildlife captive facility outlined in Section 12 encompass: (i) preventing hybridization or inbreeding; (ii) maintaining a comprehensive record book of all facility animals; (iii) submitting information to the Director General regarding the animals annually within three months after each calendar year; (iv) ensuring that animals are housed in controlled environments, except in the case of open wildlife ranches; (v) establishing open wildlife ranches if they are located within one kilometer of protected areas; and (vi) guaranteeing the welfare and safety of the animals within the facility. Section 26 delineates that any wildlife captive facility involved in breeding CITES-listed species must adhere to specific agreements negotiated between the relevant authorities and the facility operator in consultation with the Director General. Additionally, a written permit from the Director General is required for the transportation and reintroduction of animal species into the wild.
