Wildlife Conservation (Special Wildlife Investment Concession Areas) Regulations, 2021.

Comprising 44 articles, these Regulations aim to govern the designation, management, and procurement of Special Wildlife Investment Concession Areas in game reserves and controlled areas. They outline procedures for application, approval, negotiation, and awarding of concessions, as well as the associated fees, transfers, cancellation, and other conditions. Article 5 addresses the criteria for designating concession areas, allowing the Minister to designate land upon the Board's recommendation, with requirements for a General Management Plan or Resource Management Zone Plan. Additionally, Article 6 mandates the Authority to conduct feasibility studies for viable solicited projects in Special Wildlife Investment Concession Areas.
The Conservation Commissioner's key roles encompass advising the Board on investment, contracts, and project implementation in wildlife investment concession areas, overseeing concession planning, processing applications, negotiating terms, conducting audits, and managing the concession database. Furthermore, the Commissioner monitors concession performance by evaluating concessionaires against parameters in the First Schedule of the Regulations. Articles 24-31 detail the negotiation and award of concession contracts between the Tanzania Wildlife Management Authority (TWMA) and concessionaires, along with fees, charges, and related conditions. The regulations also cover fees paid by the Concessionaire, such as an annual rental fee tied to turnover and profit (with a 50% discount for locally owned companies), royalties, application fees, concession user right transfer fees, and user right transfer fees. Additionally, the regulations address the potential cancellation of user rights by the Minister for Natural Resources and Tourism in cases of non-compliance or underperformance by the Concessionaires.
