Decree No. 1120 of the Cabinet of Ministers validating the Regulation on control of transboundary movement of hazardous waste and utilization/disposal thereof and Yellow and Green lists of waste.

This Regulation establishes the procedure for the state control over transboundary movements of hazardous waste and utilization/disposal during their export from Ukraine, import into Ukraine or transit through the territory of Ukraine. Control over transboundary movement of hazardous waste and utilization/disposal thereof (Annex 1 to this Regulation) is based on the procedure of written notification to the competent authorities of the States concerned of any transboundary movement of hazardous waste and their receipt of written consent for transportation. The notification may be filed by: waste producer; exporter; competent authority of the State of export (person appointed by the competent authority). The main documents used in the procedure for notification and for obtaining written consent for transportation, as well as for the convoy of transboundary movement of hazardous waste, shall be notification confirming the consent for the transboundary transportation (Annex 3 to this Regulation) and transport document in which the fact of shipment, passage of points of entry through the state border, receipt by the recipient and the completion of utilization/disposal of waste procedure are certified (Annex 4 to this Regulation). Import-export operations related to hazardous waste shall be regulated by contracts between exporter and consignee responsible for acceptance and utilization/disposal of hazardous waste. Hazardous waste can be imported exclusively in the presence of written authorization issued by the Ministry of Environmental Protection. Import of hazardous waste to Ukraine for the purpose of storage or burial thereof shall be prohibited. Transit of hazardous waste through the territory of Ukraine shall be prohibited without prior written consent of the Ministry of Environmental Protection, which can refuse any transit of hazardous waste, substantiating the causes of such decision. Hazardous waste subject to transboundary movement shall be classified in accordance with International classification of wastes.
