Decree No. 1138 of the Cabinet of Ministers “On the implementation of an experimental project related to the procedure of artificial breeding, growing of aquatic biological resources and their use in special fish breeding enterprises and the conduct of auctions for the sale of regime of exploitation of fishery waterbodies by electronic auction”.

In order to introduce innovative methods for public administration in the field of fisheries and fishing industry, a transparent mechanism for the sale of fishery exploitation regimes of waterbody, the Cabinet of Ministers of Ukraine decrees to accept the proposal of the Ministry of Energy and Environment for implementation from January 1, 2020 until December 31, 2021 by the State Fisheries Agency of an experimental project on the implementation of the procedure for artificial breeding, growing of aquatic biological resources and their use in special fish breeding enterprises and the conduct of auctions for the sale of regime of exploitation of fishery waterbodies by electronic auction. This Decree validates the Provisional procedure for implementation of experimental project on implementation of the procedure for artificial breeding, growing of aquatic biological resources and their use in special commercial fish breeding enterprises and the Provisional procedure for the implementation of experimental project for the sale of regime of exploitation of fishery waterbodies through electronic auction. the Provisional procedure for implementation of experimental project on implementation of the procedure for artificial breeding, growing of aquatic biological resources and their use in special commercial fish breeding enterprises establishes the mechanism of artificial breeding, growing of aquatic biological resources and their use in special commercial fish breeding enterprises. Special use of aquatic biological resources in the regime of fishery exploitation of a waterbody shall be intended a type of special use of aquatic biological resources, which is carried out by the user of aquatic biological resources on the basis of the regime of fishery exploitation of a waterbody in a special commercial fish breeding enterprise in accordance with the permit for special use of aquatic biological resources in fishery waterbodies (parts thereof). Special use of aquatic biological resources in the regime of fishery exploitation of a waterbody is carried out by the user of aquatic biological resources individually and provides for the reproduction and extraction (capture) of aquatic biological resources in accordance with the requirements established by the regime of fishery exploitation of a waterbody, for the purpose of conservation and rational use of aquatic biological resources. The period of validity of the regime of fishery exploitation of a waterbody shall not exceed 10 years.
