Decree No. 200 of the Cabinet of Ministers validating the criteria for assessing the degree of risk from the performance of economic activities in the field of protection of rights to plant varieties and establishing the periodicity of conduct of planned state supervision by the State Service of Safety of Foodstuffs and Consumer Protection.

This Decree establishes the following degree of risk from the performance of economic activities in the field of protection of rights to plant varieties: (a) the acquisition and use of intellectual property by legal entities and natural persons of intellectual property rights to plant varieties in accordance with the legislative requirements on the protection of plant variety rights related to proprietary rights of intellectual property for a plant variety certified by a patent for a variety plants; intellectual property rights to the distribution of plant variety certified by certificate of state registration of a plant variety; personal non-proprietary intellectual property rights certified by the certificate of authorship to a plant variety; production, use, storage, trade and reproduction in economic activity; (b) examination of the application for a plant variety; and (c) import of planting material (seeds) of unregistered varieties in Ukraine plants According to the established criteria, economic entities belong to one of the three levels of risk - high, medium, and low. Planned measures of state supervision (control) over the activities of economic entities management shall be performed with the following frequency: high risk level - no more than once every two years; average risk level - no more than once every three years; low risk level - not more than once every five years.
