Decree No. 705 of the Cabinet of Ministers “On some issues related to implementation of the Law No. 3348-XII on plant quarantine.

This Decree determines the procedure for conducting visual examination, check, analysis, disinfection and inspection (registration and issuance of phytosanitary and quarantine certificates) of plant species subject to regulation. The results shall be legalized by the state phytosanitary inspector in the form of an act (Annex 1) in duplicate: the first copy shall be issued to the representative of the owner of the plant species subject to regulation, the second one shall be submitted to the body of the State Food Safety and Consumer Protection Service who issued it. Plant species shall be subject to regulation in relation to plant quarantine for the purpose of control over movement thereof on the territory of Ukraine for the purposes of import, export and re-export, and shall be subject to inspection by the state phytosanitary inspector. The review of the objects of regulation shall be performed through inspection, in the course of which the sampling shall be carried with a view of conducting phytosanitary examination. To ensure sampling during inspection of crops, planting grounds, perennial plantations, warehouses, pheromone traps, food bait and catching belts must be used. Experts in the field of plant quarantine, registered by the State Food Safety and Consumer Protection Service can be involved in the operations. With a view of detection and identification of harmful organisms by the phytosanitary laboratories of the State Food Safety and Consumer Protection Service shall be performed phytosanitary examination, which includes: (a) analysis of the phytosanitary state of plant species subject to regulation for the purpose of detection of harmful organisms; (b) identification of the types of harmful organisms and pests; and (c) preparation of conclusion of phytosanitary examination.
