Law No. 124-VIII “On technical regulations and conformity assessment”.

This Law defines the legal and organizational framework for the development, adoption and application of technical regulations and the conformity assessment procedures provided for therein, as well as the implementation of voluntary conformity assessment. This Law regulates relations arising in connection with the development and adoption of technical regulations and the conformity assessment procedures provided for therein, their application to products that are placed on the market, made available on the market or put into operation. Document of conformity shall be intended a declaration (including a declaration of conformity), report, conclusion, certificate (including a certificate of conformity) or any other document confirming the fulfillment of the specified requirements relating to the object of conformity assessment. Importer shall be intended any individual or legal entity - a resident of Ukraine, who places products originating from another country on the Ukrainian market. Assessment body - a body (enterprise, institution, organization or their structural unit) that carries out conformity assessment activities, including calibration, testing, certification and inspection. Inspection shall be intended the examination of a product, process, service or installation or their design and the determination of their conformity with specific requirements or, based on professional judgment, with general requirements. Object of conformity assessment shall be intended a specific material, product, installation, process, service, system, person or body to which conformity assessment is applied. This Law applies to all types of products, except: (a) construction sites; (b) aviation facilities; (c) works of art and unique folk crafts; and (d) antiques. The provisions of this Law relating to the designation of conformity assessment bodies and designated bodies shall not apply to: (a) certification of seeds and planting material; (b) certification of organic production and/or circulation of organic products; and (c) certification of goods with registered geographical indications or traditional specialties guaranteed. The objectives of adopting technical regulations are to protect the life and health of humans, animals and plants, protect the environment and natural resources, ensure energy efficiency, protect property, ensure national security and prevent business practices that lead the consumer (user) into deception. Conformity assessment can be mandatory and voluntary. This Law contains X Sections divided into 47 Articles. Section I lays down general provisions. Section II establishes powers of executive bodies in the field of technical regulation. Section III establishes technical regulations and conformity assessment procedures. Section IV regards development and adoption of technical regulations and conformity assessment procedures. Section V regards provision of information on technical regulations, standards and conformity assessment procedures. Section VI deals with conformity assessment. Section VII regards designated bodies. Section VIII deals with acknowledgement of conformity assessment results. Section IX regards control and responsibility. Section X lays down final and transitional provisions.
