Law No. 185-V “On the management of state-owned objects”.

This Law, in accordance with the Constitution of Ukraine, defines the legal framework for the management of state-owned objects. Management of state property objects shall be intended the exercise by the Cabinet of Ministers of Ukraine and the bodies authorized by it, other entities defined by this Law, of powers to exercise the rights of the state as the owner of such objects, related to their possession, use and disposal, within the limits determined by the national legislation, in order to meet state and public needs. The objects of state property management are: (a) property transferred to state-owned enterprises and state non-profit enterprises for operational management; (b) property transferred to state commercial enterprises, institutions and organizations; (c) property transferred to state economic associations; (d) corporate rights owned by the state in the authorized capitals of economic organizations; (e) state property that ensures the activities of the President of Ukraine, the Verkhovna Rada and the Cabinet of Ministers; (f) state property transferred for rent, leasing; (g) state property transferred and/or created (built) on the basis of an agreement concluded within the framework of a public-private partnership (including a concession agreement); (h) state property that is on the balance sheet of economic organizations and is not included in their authorized capital or remains after the liquidation of enterprises and organizations; (i) state property transferred for indefinite free use to the National Academy of Sciences of Ukraine and branch academies of sciences; and (j) state property granted to a business entity on the right of economic management in accordance with the legislation. The state management holding company has the status of an authorized management body with respect to the management of state property objects transferred to its authorized capital and the authorized capital of its corporate enterprises.
