Abstract
This Law defines the legal principles of supporting and protecting economic competition, limiting monopolies in economic activity and is aimed at ensuring the effective functioning of the national economy based on the development of competitive relations. Economic competition shall be intended a competition between economic entities with the aim of obtaining advantages over other economic entities through their own achievements, as a result of which consumers, economic entities have the opportunity to choose between several sellers, buyers, and an individual economic entity that can determine the conditions of the circulation of goods on the market. This Law regulates the relations of state authorities, local self-government bodies, administrative and economic management and control bodies with business entities; business entities with other business entities, with consumers, other legal entities and natural persons in connection with economic competition. State policy in the field of development of economic competition and limitation of monopolies in economic activity, implementation of measures regarding demonopolization of the economy, financial, material and technical, informational, advisory and other support of business entities that contribute to the development of competition is carried out by state authorities, bodies of local self-government and bodies of administrative and economic management and control. The economic entity occupies a monopoly (dominant) position on product market, if: (a) it has no competitor in this market; and (b) is not subject to significant competition due to the limited access opportunities of other economic entities regarding the purchase of raw materials, materials and sales of goods, the presence of barriers to market access of other economic entities, the presence of benefits or other circumstances. Business entities and associations are prohibited from inciting other business entities to commit violations of the legislation on the protection of economic competition or to facilitate the commission of such violations.
