Abstract
This Law regulates relations between consumers of goods, works and services and business entities, regardless of the form of ownership, that produce, sell goods or foodstuffs, perform works or provide services, establishes consumer rights, and also determines the mechanisms for their protection and the basis for implementing state policy in the field of consumer rights protection. Consumer rights protection is carried out according to the principles of: (a) priority of the rights and interests of consumers over any other interests and goals of business entities; (b) openness, transparency and systematicity of the formation and implementation of state policy in the field of consumer rights protection; (c) independence and impartiality of state authorities and local self-government bodies that protect consumer rights; (d) consideration of consumer interests when forming state policy in other areas; (e) decision-making in favor of the consumer if the norm of a law or other regulatory legal act issued in accordance with the law or if the norms of different laws or different regulatory legal acts allow for an ambiguous (multiple) interpretation of the rights and obligations of the consumer or business entity, as well as if the contract between the business entity and the consumer provides for unclear or ambiguous provisions; (f) availability to the consumer of simple and effective methods of recovery of violated rights; (g) protecting the economic interests of consumers from unfair and misleading or aggressive commercial practices and enhancing the role of public consumer associations in preventing such activities; (h) promoting activities to develop, modernize and support technological tools (databases, information and telecommunications systems) in the field of consumer rights protection; (i) availability to the consumer of useful and understandable information regarding the offered goods, works, and services, including information that provides the ability to identify products and trace their origin; (j) taking into account the needs of vulnerable categories of consumers; and (k) ensuring the protection of consumers' personal data. Labels regarding the selling price of products and the price per unit of product must be clear and easy to understand. Unclear or ambiguous provisions of a consumer contract shall be interpreted in accordance with consumer benefit. Unfair commercial practices are prohibited. This Law contains IX Sections divided into 44 Articles. Section I lays down general provisions. Section II establishes consumer rights. Section III regards features of consumer rights in the event of conclusion of a contract outside commercial or office premises or a distance contract. Section IV regards unfair commercial practices. Section V establishes consumer rights protection system. Section VI regards resolution of consumer disputes. Section VII establishes liability for violation of the legislation on consumer rights protection. Section VIII regards international cooperation. Section IX lays down final and transitional provisions.
