Abstract
This Law establishes the legal and organizational framework for the prevention, reduction and control of pollution resulting from the activities defined by this Law, in order to ensure a high level of environmental protection and constitutional rights to an environment safe for life and health by applying an integrated approach to pollution regulation and implementing the best available technologies and management methods. An integrated environmental permit shall be issued by the licensing authority to the operator of the installation where the following activities are of will be carried out: (a) energy sector (fuel combustion in installations with a total rated thermal input of 50 MW or more; oil and gas processing; coke production; gasification or liquefaction); (b) metal ore and processing; (c) mineral processing; and (d) industrial waste management, disposal, recycling and reuse of inorganic materials. An integrated environmental permit shall be issued in accordance with the conclusions of the best available technologies and management methods. The validity period of the integrated environmental permit is unlimited. Obtaining an integrated environmental permit is mandatory for the operator of an installation that carries out the aforesaid types of activities. Requirements for content of an application for an integrated environmental permit (amendments to it) shall be approved by the Cabinet of Ministers of Ukraine. The licensing authority shall provide timely opportunities for public participation in the process of issuing an integrated environmental permit (amending it) and access to information related to the issuance of an integrated environmental permit (amending it) in accordance with the requirements of this Law. The installation operator ensures the posting of an announcement about the start of a public discussion in the process of issuing an integrated environmental permit (amending it) throughout the entire period of public discussion. An integrated environmental permit consists of a descriptive, motivational part and conditions, which are an integral part of the integrated environmental permit. This Law establishes maximum permissible limits for emission originating from the direct or indirect release, including discharge, of substances, vibrations, heat, noise or other physical and biological factors from an installation into atmospheric air, water, land or subsoil. The term "emission" does not include the release of radioactive substances and genetically modified organisms. Transboundary consultations on the likely significant negative impact on the environment of foreign states as a result of the operation of installations located in Ukraine, as well as the likely significant negative impact on the environment of Ukraine as a result of the operation of installations located in foreign states are held in cases provided for by international treaties of Ukraine, the binding consent of which has been granted by the Verkhovna Rada (Parliament) of Ukraine. The procedure for conducting transboundary consultations shall be approved by the Cabinet of Ministers of Ukraine. This Law contains 29 Articles.
