Abstract
The Civil Code of Ukraine was adopted by the Verkhovna Rada on 16 January 2003. It regulates personal non-property and property relations (civil relations), based on legal equality, free will, property independence of their participants. The Code is structured into six Books, as follows: I) General provisions; II) Personal Intangible Rights of an Individual; III) Ownership and other property rights; IV) Intellectual property rights; V) Law of obligations; VI) Inheritance law.
OWNERSHIP AND REAL RIGHTS. Book Three sets out rules and principles governing porperty and other real rights. Article 316 gives the definition of ownership: it is "the right of a person to a thing (property), which he exercises in accordance with the law at his own will, regardless of the will of other persons." Further, it states that a special type of property right is the right of trust property, which arises as a result of a law or contract. This Book is divided into two Chapters: Chapter 1 concerns property rights; Chapter 2 concerns property righs to other people's property. Provisions on common property, servitudes, righs of use are laid down. Specific provisions regulate the right to use a plot of land for agricultural purposes (emphyteusis). Chapter 33 of this Book applies to the righ to use land plots for agricultural needs.
OBLIGATIONS AND CONTRACTS. Book Five sets out general provisions on obligations. Firstly, the concept of obligation is defined along with grounds for its occurrence and parties in liability (art. 509). Further provisions under this Book regard execution, ensuring the fulfillment of obligations, termination of obligations, liability for breach of obligations. Chapter 2 of Book Five applies to contracts in general and special types of agreement, including purchase-sale, lease, loan, insurance.
INHERITANCE. Law of succession includes inheritance by law (articles 1258-1285) and by will (articles 1286-1308).
