Abstract
This Law primarily addresses the legal framework governing the traceability of aquatic bioresources and products derived from them within the national territory. It establishes the foundational legal, economic, and organizational principles for regulating operations involving these resources, especially in the context of circulation within the national territory and international trade. The Law emphasizes the importance of aligning national standards with European and global norms, and it incorporates international treaties into Ukraine's legal system. The overarching policy goal is to ensure sustainable use, conservation, and transparent management of aquatic bioresources, with a focus on preventing illegal, unregulated, and unreported activities. Key measures outlined include the development and implementation of an electronic traceability system, which is integral to the management of aquatic bioresources. The Law specifies procedures for the formation, marking, and sale of industrial fishing and aquaculture lots, including detailed requirements for labelling, documentation, and reporting within strict timeframes—such as two hours for reporting sales and operations. It mandates the certification of catch and re-export certificates, with clear criteria for their issuance, re-establishment, and annulment, and prescribes responsibilities for tracing operators and authorities. The Law also delineates the roles of various state bodies, including the Cabinet of Ministers and central executive agencies, in approving procedures, overseeing compliance, and ensuring transparency. Implementation mechanisms involve the use of a centralized electronic system managed by designated authorities, with specific procedures for data entry, processing, and protection of personal data. The Law stipulates timelines for adopting necessary normative legal acts—such as within one year of enactment—and assigns responsibilities to ministries and other bodies for aligning their regulations accordingly. Enforcement provisions include supervision, control measures, and penalties for violations, emphasizing the importance of procedural compliance and stakeholder involvement in maintaining the integrity of the aquatic bioresources management system.

This Law enters into force one year from the date of its publication, but not earlier than the date of notification on the official website of the central executive body implementing state policy in the field of fisheries about the start of operation of the electronic system for the traceability of aquatic bioresources and/or products produced from aquatic bioresources.
