Abstract
This Law shall define the legal and organizational principles of exercising the right to freedom of association guaranteed by the Constitution of Ukraine and international treaties of Ukraine, the binding nature of which was approved by the Verkhovna Rada of Ukraine, the procedure for establishing, registration, operation and termination of public associations. A public association means a voluntary association of individuals and/or legal entities of private law for the exercise and protection of rights and freedoms, satisfaction of public, in particular economic, social, cultural, environmental, and other interests. According to its organizational and legal form, a public association shall be formed as a public organization or public union. A public organization means a public association, the founders and members (participants) of which are individuals. A public union means a public association, the founders of which are legal entities under private law, and its members (participants) may be private legal entities and individuals. A public association can carry out activities with or without the status of a legal entity. A public association with the legal entity status is a non-entrepreneurial company, the main purpose of which is not to make a profit. This Law shall be applied to public relations in the field of establishing, registration, operation and termination of public associations in Ukraine. Public associations shall be established and operated on the following principles: (a) voluntary nature; (b) self-government; (c) free choice of the territory for operation; (d) equality before the law; (e) no property interest of their members (participants); and (f) transparency, openness and publicity. Proper name of a public association can contain information about the public association status (“children's”, “youth”, “all-Ukrainian”) and/or about its type (“environmental”, “human rights”, etc.).
Entry into force notes
This Law enters into force as of the day following the day of its publication and shall be effective as of 1 January 2013.
