Order No. 1191 of the Cabinet of Ministers on some issues of the implementation of an experimental project on the introduction of auctions for the sale of the right to enter into lease agreements for the use of the water area (water space) of internal sea waters, territorial sea, exclusive (marine) economic zone of Ukraine for marine aquaculture purposes through electronic bidding.

This Order establishes the procedure for the sale at an auction through electronic bidding of the right to enter into lease agreements for the use of the water area (water space) of internal sea waters, the territorial sea, the exclusive (marine) economic zone of Ukraine for the purposes of marine aquaculture. The operator provides the organizer, applicants, participants and observers with permanent access to the electronic trading system in order to obtain information about the progress of the auction. The scientific-biological substantiation for the definition of the water area (water space), its borders (coordinates) is developed at the organizer's own initiative or on the basis of an application by the aquaculture subject, which must specify: (a) the water area (water space), its borders (coordinates), on which it is planned to carry out economic activity in marine aquaculture; and (b) types of aquatic bioresources that are planned to be grown in the relevant water area (water space). Participants at the auction sale of the right to enter into lease agreements for the use of the water area (water space) of internal sea waters, the territorial sea, the exclusive (marine) economic zone of Ukraine for the purposes of marine aquaculture shall be individual entrepreneurs, legal entities and foreign legal entities residing of the territory of Ukraine.
