Resolution No. 1102 of the Cabinet of Ministers validating the Waste Classification Procedure and the National Waste List.

This Procedure determines the scheme for classifying waste by type and properties in order to properly manage waste, prevent its negative impact on human health and the environment or reducing such impact. Waste shall be classified by: (a) waste generators, except for household waste generators; and (b) business entities in the field of waste management. In cases where the waste generator is unknown, waste classification is carried out by the waste owner. Classification is carried out in accordance with the National List of Wastes, with the consideration of Appendix 3. Each item of the National List of Waste consists of a waste code and a waste name in Ukrainian. Classification is based on: (a) known facts about the content and components of waste, product information, safety data sheets; (b) the presence of hazardous substances or components containing hazardous substances; (c) determination of the hazard for each property in accordance with Annex 1; (d) a description of the activity that resulted in the waste; (e) a description of the process, action or procedure that resulted in the waste; and (f) determining the number of fractions that make up the waste. The hazardous property is assessed on the basis of: (a) concentrations of chemicals in waste; and (b) conducting research.
